General Terms & Conditions

Listed below is our normal Terms & Conditions. These may vary slightly between each property. A full set of Terms & Conditions will be sent specific to each property along with the Short Term Letting Contract during the booking process.

Holiday-Chiclana is a mediator between the owner of the property and the client. The contract will be between the Owner and Client.

Bookings

After confirmation of availability by email or telephone by Holiday Chiclana a provisional booking is held up to 7 days pending a non-refundable deposit of 30 - 50% , payable by bank transfer, all bank charges to be paid by client. We strongly advise that travel insurance is obtained before travelling.

Terms and conditions are being accepted by paying the deposit or the full amount due

Balance of payment

Due on arrival in Euro cash. Failure to do so may lead to an additional charge or immediate vacation of the property without compensation.

Breakages & Damages

A 200 to 500 Euro Breakages deposit will be required on arrival. This deposit will be returned in full between 09:00am and 20:00pm unless any breakages are identified, which fall outside of normal Wear & Tear. If clients leave outside of 09:00 & 20:00pm the owner or agent has the right to return the security deposit by bank transfer within 7 days of departure.

This is a privately owned property and customers are trusted to report any breakages or damages to the local contact as soon as they occur. Failure to report any damages as they happen could result in the forfeit of the whole amount of the Breakages deposit.

If any appliances or equipment does not function properly or if guests have any complaints at all it is essential that these are reported immediately to the local contact, otherwise we may not be held responsible.

The property is to be vacated in a reasonably clean and tidy condition similar to the one found on arrival, swept, work surfaces wiped, dirty dishes washed and all rubbish disposed of.

Occupancy, Arrival and Departure times, changeover day

The number of occupants must not exceed stated capacity and no further guests of the clients are allowed on a daily basis without prior approval of the owner or agent. No pets are allowed under any circumstances, unless agreed in advance with the LESSOR. Failure to comply with the above may lead to an additional charge or immediate vacation of the property without compensation.

The accommodation is available on the arrival day from 15:00 and will be vacated on the departure day by 10:00.

Security and Safety

Customers are responsible for the keys of the property whilst in their possession and returned to the local contact or deposited as advised. There is a key replacement charge of 50 Euros if lost.

The owner or agents are not liable for any damages or injuries to persons or property belonging to any occupant.

The owner or agent cannot be held responsible or offer insurance for items stolen from the property or grounds during your stay.

The use of swimming pools is strictly at the guest’s own risk. Parents are responsible for the supervision of children particularly in and around pools. No responsibility will be accepted for accidents occurring in and around the property.

Children under the age of 16 cannot be left in the property without adult supervision.

Others

Holiday-Chiclana has the right to offer an alternative property of equal or higher quality in the event that the reserved property is unavailable at short notice due to matters beyond our control. It this is not possible then the owner or will refund the whole amount paid and Holiday Chiclana will not be under any further liability.

The owner or agent cannot take any responsibility for events caused by customs and or situations typical in the country. For example, power cuts, temporary loss of water supply, barking dogs, cockerels, ants, mosquitoes and noisy neighbours.

If there are any problems, the tenant should inform the landlord’s agent in Spain as soon as possible so that they can try to resolve the issue.

To ensure the property is well maintained access to the property, pool and garden cannot be denied. We will endeavour to ensure that we carry out this work during the mornings where possible.

Limitation of Liability

The contractual liability is limited to the rental price only as far as any damage caused to you is not intentional or an act of negligence by the landlord.

The landlord cannot be held liable for inconveniences caused by a third party, that is to say airlines, car rental companies etc….
